Here you may report in a secure manner infringements and acts of corruption or related offences in accordance with the General Rules of Protection of Infringement Reporters, approved by Law 93/2021 of 20 December, as well as the General Corruption Prevention Scheme, approved by Decree-Law No 109-E/2021December 9th.
What is the Complaint Channel?
The Complaint Channel, it is an online platform for registration and treatment of complaints, being an essential tool for the detection of all types of irregularities of corruption and related infringements.
What can be reported?
Complaints concerning matters falling within the jurisdiction of the AGSE,I.P. shall be considered, including events relating to acts of corruption and related offences, or any irregularities or illegalities committed within entities subject to its supervision under the general corruption prevention regime.
Corruption and related offences of active and passive corruption, receiving and offering undue advantage, embezzlement, economic participation in business, concussion, abuse of power, prevarication, trafficking of influence, laundering or fraud in obtaining or deviating from grant, grant or credit.
What are the essential elements of the complaint?
The complaint shall essentially provide the following:
- a brief, objective and clear description of the facts subject to the complaint;
- the location and date of occurrence of the facts;
- who is involved in the facts indicating the identity(s) and functions of persons involved in suspicion or authorship and who knows the facts best (potential witnesses);
- sending evidence of the facts reported or how to obtain them.
What treatment is given to a complaint lodged?
The complaints submitted shall be the subject of technical analysis by the Reporter who may:
- file for non-illicit or lack of evidence allowing further investigation;
- forward the complaint to the internal department or external competent authorities (administrative, investigative or judicial);
What protection is given to the whistleblower?
- Confidentiality on the identity of the complainant shall be guaranteed in accordance with Article 18 of the Law 93/2021, of 20 December, save legal obligation or judicial decision.
- In the processing of the complainant’s personal data, Article 19 of Law 93/2021 of 20 December will be observed.
- The complainant shall benefit from the protection and support measures and, in particular, from the guarantees provided for in Articles 22 and 23 respectively. Law 93/2021December 20th.
- The complainant also benefits from the liability scheme provided for in Article 24 of Law 93/2021 of 20 December.
